Создание единой научно-образовательной системы
принципиально нового качества невозможно без разработки новых правил
финансирования науки. Старые правила созданы давно и сегодня не достаточно
эффективны.
Влияние вузовских исследований на развитие
фундаментальной российской науки имеет глубокие корни и разгосударствление
образовательных учреждений, выборочная система финансирования и некоторые
другие аспекты реформирования каналов финансирования современной образовательной
системы воспринимаются неоднозначно современным научным сообществом.
Вузовская наука всегда являлась наиболее активным и
динамичным поставщиком российских знаний. Ежегодно образовательные учреждения
пополняют научные достижения результатами только что проведенных опытов и
экспериментов. Именно вузовские исследования формируют активный приток новинок
во все сферы научной деятельности, как России, так и других стран мира. Однако
только 40 % всех вузов страны выделяют средства на научные исследования, и
только в 17 % образовательных учреждений объем этих средств достигает 20 млн
руб. и более. Это явление заставляет задуматься о качестве дипломов,
получаемых выпускниками вузов. Недостаток опробованных на практике знаний является
причиной невостребованности молодых специалистов на рынке труда в современных
экономических условиях. Этим и объясняется желание Министерства образования и
науки РФ ограничить количество вузов, которые в результате реформирования
останутся на бюджетном финансировании государства.
В современном мире давно сложилась эффективная система многоплановой
поддержки государством научных учреждений из различных источников: от
бюджетного финансирования вузов до целевой поддержки отдельных проектов или
ученых.
Всех волнует недостаточность правовой базы,
регулирующей процесс интеграции образования, производства и науки. Модели
процессов интеграции могут быть различные. В частности, предполагается, что
новые формы интеграции будут формироваться как на базе университетов, так и на
основе институтов Российской академии наук, государственных научных центров и
негосударственных научных организаций. Университетам, выполняющим широкомасштабные
научные исследования, будет присвоен статус исследовательских университетов или
государственных научно-образовательных центров. В вузах, в которых есть
соответствующие научно-исследовательские структуры, также будут создаваться
технопарки, учебные центры и научно-образовательные центры по приоритетным
научным направлениям.
Для формирования многоплановой структуры
финансирования науки наряду с финансированием научной деятельности на
конкурсной основе, предлагается сметное бюджетное финансирование научных институтов
в структуре исследовательских университетов, формирование филиалов
университетов на базе наукоградов, крупных научных центров, создание центров
коллективного пользования научным оборудованием, телекоммуникационных сетей,
совместных центров научно-технической информации и т.д.
Наиболее часто используются
такие формы финансирования научных разработок, как гранты, целевое
финансирование, заключение госконтрактов и др.
Гранты - один из самых распространенных видов
целевого финансирования науки. Гранты предоставляются на безвозмездной и
безвозвратной основе российскими физическими лицами, некоммерческими
организациями, а также иностранными и международными организациями и
объединениями. Существует перечень ор-ганизаций-грантодателей, периодически
обновляемый и утверждаемый Правительством РФ, поступления от которых на осуществление
конкретных программ, в том числе в области образования и науки, не подлежат
налогообложению с точки зрения уплаты налога на прибыль и налог на доходы
физических лиц (НДФЛ). Как правило, гранты выделяются на конкурсной основе. Каждый фонд
разрабатывает свои условия предоставления финансирования грантода-телем. Выдача
гранта оформляется путем заключения грантового соглашения (договора). И хотя
Гражданский кодекс РФ (ГК РФ) не предусматривает такой вид обязательств, как грант,
никаких запретов на заключение таких договоров и урегулирование отношений
между грантодателем и грантополучателем не установлено.
По гражданскому
законодательству наиболее близок к гранту договор пожертвования. Однако
существует одно серьезное отличие между этими двумя видами правоотношений,
которое выделяет гранто-вые соглашения в отдельную категорию. Пожертвование
может быть осуществлено и без указания конкретной цели. Что же касается
гранта, то его характерной особенностью является именно целевой характер
предоставления. Поэтому в грантовом соглашении, как правило, стороны фиксируют
следующие моменты: цели, на которые выделяется финансирование; срок реализации
проекта; порядок учета средств гранта, их использования и предоставления отчетности
грантодателю; условия взаимодействия сторон в случае установления факта
нецелевого использования выделенных средств. Поскольку грант
предоставляется на безвозмездной основе, то у грантодателя не возникает каких-либо прав на полученные результаты
деятельности грантополу-чателя, равно как и на оборудование или иные материалы,
приобретаемые грантопо-лучателем за счет средств гранта.
Целевое финансирование. Средства на проведение
различных научных работ могут также выделять специализированные отраслевые и
межотраслевые научные и научно-технические фонды, в частности Российский фонд
фундаментальных исследований, Российский фонд технологического развития,
Российский гуманитарный научный фонд, Фонд содействия развитию малых форм
предприятий в научно-технической сфере, Федеральный фонд производственных
инноваций. Все виды поддержки научных исследований и проектов производятся на
конкурсной основе. Финансирование отобранных проектов осуществляется в рамках
договора (как правило, договора на выполнение научно-исследовательских и
опытно-конструкторских работ (НИОКР), который заключают соответствующий фонд и организация-победитель
конкурса. Права на объекты интеллектуальной собственности, на результаты
научно-технической деятельности, полученные при выполнении работ,
финансируемых за счет средств фондов, реализуются в соответствии с ГК РФ. В настоящее
время складывается тенденция к закреплению прав на полученные результаты за
организацией-исполнителем с предоставлением РФ прав на безвозмездное
некоммерческое использование этих результатов в целях выполнения работ или
осуществления поставок продукции для федеральных государственных нужд.
Заключение государственных контрактов. Еще одним способом
финансирования НИОКР является заключение государственных контрактов (в том
числе и в рамках выполнения различных государственных целевых программ).
Отношения сторон в данном случае полностью регулируются ГК РФ и Федеральным законом РФ от
21 июля 2005 г. № 94-ФЗ «О размещении заказов на поставки товаров, выполнение
работ, оказание услуг для государственных и муниципальных нужд». Порядок
отбора исполнителей на выполнение НИОКР для государственных нужд, процедуры
заключения государственных контрактов на выполнение НИОКР по результатам
конкурса, а также сопровождения контрактов и приемки отдельных этапов работ
устанавливаются непосредственными государственными заказчиками в соответствии
с законодательными нормами. Субсидии и субвенции. Для финансирования
фундаментальных научных исследований и опытно-конструкторских работ, внедрения
в производство новой техники, переподготовки кадров и прочих целей научной
организации могут быть предоставлены субсидии или субвенции, то есть денежные
средства, выделяемые федеральным или местным бюджетом, или же специальными
фондами на безвозмездной и безвозвратной основе на реализацию определенных
целей. Право на получение субсидий или субвенций может быть предоставлено
организации на условиях конкурсного отбора. Данные средства относятся к
доходам, которые не учитываются при налогообложении прибыли при условии их
целевого использования, и должны подлежать отдельному учету у организации-получателя.
В случае нецелевого использования предоставленное финансирование может быть
отозвано.
В соответствии с последними изменениями, внесенными в
Бюджетный кодекс РФ, государственным (муниципальным) учреждениям субсидии из
средств федерального (регионального или местного) бюджетов не предоставляются,
по всей видимости, в целях сокращения различных видов государственного
финансирования бюджетных учреждений и учета поступающих средств на различных
счетах.
Все сложившиеся на сегодня
способы финансирования научной деятельности носят строго целевой характер, при
условии соблюдения которого организации-получатели имеют налоговые льготы (в
том числе в части освобождения от уплаты налога на прибыль, налога на
добавленную стоимость (НДС), НДФЛ). Также выделение средств сопровождается строгой
отчетностью их получателя. В большинстве приведенных случаев права на
полученные результаты также сохраняются за организацией-исполнителем, но
могут ограничиваться определенными требованиями в части последующего их
использования и внедрения.
Финансирование научной и/или научно-технической
деятельности осуществляется государством на основе сочетания финансовой
поддержки научных организаций и целевого финансирования конкретных научных и
научно-технических программ и проектов, что установлено пунктом 6 статьи 15
Федерального закона от 23.08.1996 г. № 127-ФЗ «О науке и государственной научно-технической
политике» (далее - Закон № 127-ФЗ).
Например, Федеральным законом от 02.12.2009 г. №
308-ФЗ «О федеральном бюджете на 2010 г. и на плановый период 2011 и 2012
годов» на поддержку государственных академий наук и их региональных отделений
предусмотрены средства в размере 65 552 261,5 тыс. руб. На
научно-исследовательские и опытно-конструкторские работы в рамках Федеральной
целевой программы «Повышение безопасности дорожного движения 2006-2012 годах»
направлено 90 375,0 тыс. руб., а в рамках Федеральной целевой программы «Пожарная
безопасность в Российской Федерации на период до 2012 года» - 182 076,0 тыс.
руб. На гранты в области науки, культуры, искусства и средств массовой
информации в бюджете Российской Федерации заложены средства в сумме 7 523
793,0 тыс. руб.
Согласно статье 5 Закона №
127-ФЗ, научной организацией признается юридическое лицо независимо от
организационно-правовой формы и формы собственности, а
также общественное объединение научных работников, осуществляющие в качестве
основной научную и/или научно-техническую деятельности, подготовку научных
работников и действующие в соответствии с учредительными документами научной
организации.
Российская академия наук, а также отраслевые академии
наук (Российские академии сельскохозяйственных наук, медицинских наук,
образования, архитектуры и строительных наук, художеств) являются
государственными академиями наук - некоммерческими организациями (статья 6
Закона № 127-ФЗ).
Некоммерческая организация, созданная собственником
для осуществления управленческих, социально-культурных или иных функций
некоммерческого характера признается учреждением. Учреждение, согласно статье
120 ГК РФ, может быть создано гражданином или юридическим лицом, так
называемое частное учреждение, либо Российской Федерацией, субъектом
Российской Федерации, муниципальным образованием, соответственно, такие
учреждения являются государственными и муниципальными.
С точки зрения главы 25 Налогового кодекса Российской Федерации (НК РФ), все доходы налогоплательщика -
научной организации - делятся на налогооблагаемые доходы и доходы, не
учитываемые при налогообложении. Из состава налогооблагаемых доходов
исключаются доходы, исчерпывающий перечень которых содержит
статья 251 НК РФ.
Имущество в виде лимитов бюджетных обязательств
(бюджетных ассигнований), доведенных в установленном порядке до казенных
учреждений, а также в виде субсидий, предоставленных бюджетным учреждениям и
автономным учреждениям, относится к средствам целевого финансирования,
которые не учитываются в целях налогообложения прибыли организаций. Такая
норма закреплена подпунктом 14 пункта 1 статьи 251 НК РФ.
К средствам целевого финансирования, не учитываемым в
целях налогообложения прибыли, подпунктом 14 пункта 1 статьи 251 НК РФ отнесены
суммы полученных грантов.
Гранты, согласно определению,
содержащемуся в Законе № 127-ФЗ, это денежные и иные средства, передаваемые
безвозмездно и безвозвратно гражданами и юридическими лицами, в том числе иностранными
гражданами и иностранными юридическими лицами, а также международными
организациями, получившими право на предоставление грантов на территории Российской Федерации в установленном Правительством
Российской Федерации порядке на проведение конкретных научных исследований на
условиях, предусмотренных грантодателями.
В целях налогообложения прибыли грантами признаются
денежные средства или иное имущество в случае, если их передача (получение)
удовлетворяет следующим условиям:
- гранты предоставляются на безвозмездной и
безвозвратной основах российскими физическими лицами, некоммерческими
организациями, а также иностранными и международными организациями и
объединениями по перечню таких организаций, утверждаемому Правительством
Российской Федерации, на осуществление конкретных программ в области образования,
искусства, культуры, охраны здоровья населения (направления: СПИД, наркомания,
детская онкология, включая онкогема-тологию, детская эндокринология, гепатит и
туберкулез), охраны окружающей среды, защиты прав и свобод человека и гражданина,
предусмотренных законодательством Российской Федерации, социального обслуживания
малоимущих и социально не защищенных категорий граждан, а также на проведение
конкретных научных исследований; -
гранты предоставляются на условиях, определяемых
грантодателем, с обязательным предоставлением грантодателю отчета о целевом
использовании гранта.
С 01.01.2009 г. действует Постановление Правительства Российской
Федерации от 28.06.2008 г. № 485 «О перечне международных организаций,
получаемые налогоплательщиками гранты (безвозмездная помощь) которых не
подлежат налогообложению и не учитываются в целях налогообложения в доходах
российских организаций - получателей грантов».
В соответствии с пунктом 6 статьи 217 главы 23 НК РФ
Правительство Российской Федерации Постановлением от 15.07.2009 г. № 602
утвердило Перечень российских организаций, получаемые налогоплательщиками
гранты которых, предоставленные для поддержки науки, образования, культуры и
искусства в Российской Федерации, не подлежат налогообложению. Данная норма применяется только
в отношении грантов, предоставленных грантода-телями налогоплательщикам -
физическим лицам, и не применяется для целей налогообложения прибыли.
Как известно, финансирование
большинства научных исследований осуществляется за счет государства или за
счет средств специализированных фондов. Финансирование всегда
носит целевой характер, то есть выделяемые средства предназначены для
реализации конкретных мероприятий и могут быть использованы лишь по
назначению. Необходимо расширить формы и источники финансирования науки,
сохранив практику освобождения целевого финансирования науки от налогообложения
и режим целевого использования средств.
